For couples that enter into ade facto relationship or intend to enter into a marriage, a prenup agreement – or binding financial agreement (BFA) – is used to determine how assets, finances, and resources are divided between spouses in the event that the relationship ends.
In cases where the relationship has already ended, a prenup agreement may also be used to determine things like spousal maintenance and child support obligations.
Preparing a Prenup Agreement
Prenuptial agreements must outline each partners financial expenses, debts, belongings, and other important (and relevant) assets or liabilities.
When prepared correctly, a prenup will outline how you and your partner split assets such as property, as well as finances, and parenting responsibilities if the de facto relationship or marriage was to end.
Prenups must be fair, and they must be enforceable. In relationships where one spouse has significantly more assets – such is the case with business owners or those with family wealth – a prenuptial agreement helps to protect their professional practice and livelihood. In cases where one partner has children from a previous relationship, a prenup agreement may also help to protect the best interests of their children in the event of a split. Prenuptial agreements must be:
