    Unfair Dismissal Claim Eligibility

In order to be eligible to file an unfair dismissal claim, employees must meet the following criteria:

    • If your employer has fewer than 15-employees, you must work for them for a continuous period of at least 12-months to be eligible for an unfair dismissal claim.
    • If your employer has more than 15-employees, you must work for them for a continuous period of at least 6-months to be eligible to make an unfair dismissal claim.

Before proceeding with your claim, our unfair dismissal and fair work lawyers will carefully review the facts of the case to ensure that the claim is valid and meets the criteria set out under the Fair Work Act (Cth) 2009.

For employees that believe that they have a claim for unfair dismissal, it is important to act fast. There is a strict 21-day limit for making an unfair dismissal claim. Any claims that are lodged outside of this period may only be considered by the Fair Work Commission or a State Commission under exceptional circumstances.

The Fair Work Commission will consider the unique circumstances of your case when deciding if a dismissal was harsh, unjust, or unreasonable. Before making an unfair dismissal claim, it’s important to seek legal guidance to understand your eligibility and receive tailored advice for your circumstances.
