    Prenuptial agreements must outline each partners financial expenses, debts, belongings, and other important (and relevant) assets or liabilities.

    When prepared correctly, a prenup will outline how you and your partner split assets such as property, as well as finances, and parenting responsibilities if the de facto relationship or marriage was to end.

    Prenups must be fair, and they must be enforceable. In relationships where one spouse has significantly more assets – such is the case with business owners or those with family wealth – a prenuptial agreement helps to protect their professional practice and livelihood. In cases where one partner has children from a previous relationship, a prenup agreement may also help to protect the best interests of their children in the event of a split. Prenuptial agreements must be:

    • Properly prepared in line with the Family Law Act 1975
    • Be enforceable and fair for both parties
    • The terms of the contract must be legal
    • Both parties must disclose all financial assets and liabilities
    • Both parties must agree to the prenup of their own free will
    • Both parties must receive independent financial advice before proceeding
